1. Agreement to Terms

By accessing or using 500Kcal.fit's website and services ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and customers of the Service. Please read them carefully before using our platform.

2. Service Description

500Kcal.fit provides a meal delivery service offering fresh, macro-balanced, healthy meals in Pune. Our services include:

  • Online ordering of pre-prepared meals
  • Meal subscription packages (credit-based system)
  • Home delivery services within Pune
  • Nutritional information and meal tracking
  • Customer support and meal customization

3. User Accounts

3.1 Registration

To use our Service, you must:

  • Be at least 18 years of age
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Verify your phone number via OTP

3.2 Account Responsibilities

You are responsible for:

  • All activities conducted under your account
  • Maintaining confidentiality of your password
  • Notifying us immediately of unauthorized access
  • Providing accurate delivery information

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks.

4. Orders and Payments

4.1 Credit System

  • 1 credit = 1 meal
  • Credits must be purchased before ordering
  • Credits are valid as per package validity period
  • Credits are non-refundable once purchased
  • Unused credits expire after validity period

4.2 Ordering Requirements

  • Orders must be placed at least 12 hours in advance
  • Delivery slots: Morning (7-9 AM) and Evening (7-9 PM)
  • Valid delivery address required within Pune
  • Sufficient credits must be available

4.3 Payment Processing

  • Payments processed through secure payment gateways
  • All prices in Indian Rupees (INR)
  • Accepted payment methods: Credit/Debit cards, UPI, Net Banking, Wallets
  • Payment must be completed to activate credits

4.4 Pricing and Availability

We reserve the right to modify pricing, discontinue products, or limit quantities without prior notice. Prices are subject to change, but orders already placed will honor the original price.

5. Cancellations and Modifications

5.1 12-Hour Cancellation Policy

  • Orders can be cancelled if delivery is more than 12 hours away
  • Cancellations within 12 hours of delivery are not permitted
  • Cancelled orders result in credit refund
  • Refunded credits are immediately available for reuse

5.2 Order Modifications

Order modifications (delivery time, meal changes) must be requested more than 12 hours before scheduled delivery time. Contact customer support for modification requests.

6. Delivery Terms

6.1 Delivery Areas

We currently deliver only within Pune city limits. Delivery to areas outside Pune is not available.

6.2 Delivery Times

  • Morning slot: 7:00 AM - 9:00 AM
  • Evening slot: 7:00 PM - 9:00 PM
  • Delivery times are approximate and may vary

6.3 Delivery Responsibilities

You must:

  • Provide accurate delivery address and contact information
  • Be available to receive the delivery
  • Inspect the order upon delivery
  • Report any issues immediately

6.4 Failed Deliveries

If delivery cannot be completed due to incorrect address, unavailability, or refusal to accept, no refund or credit will be issued.

7. Product Quality and Food Safety

We are committed to providing fresh, high-quality meals:

  • All meals prepared fresh daily
  • Strict hygiene and food safety standards
  • Temperature-controlled delivery
  • Nutritional information provided for all meals

Important: Consume meals within recommended timeframes. We are not responsible for food quality issues arising from improper storage after delivery.

8. Allergies and Dietary Restrictions

While we provide ingredient information, we cannot guarantee meals are free from all allergens. If you have severe allergies:

  • Review ingredient lists carefully before ordering
  • Contact customer support for clarification
  • Use the service at your own risk

We are not liable for allergic reactions or dietary-related issues. Please consult healthcare professionals regarding dietary needs.

9. Intellectual Property

All content on our website and app (text, images, logos, recipes, trademarks) is owned by 500Kcal.fit or licensed to us. You may not:

  • Copy, reproduce, or distribute our content
  • Use our trademarks without permission
  • Create derivative works from our content
  • Reverse engineer our software or systems

10. User Conduct

You agree not to:

  • Use the Service for illegal purposes
  • Attempt to hack, disrupt, or damage our systems
  • Create fake accounts or impersonate others
  • Share account credentials
  • Abuse, harass, or threaten staff or delivery personnel
  • Submit false information or fraudulent orders
  • Exploit promotions or discounts dishonestly

11. Limitation of Liability

To the fullest extent permitted by law, 500Kcal.fit shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from service interruptions or errors
  • Third-party actions (delivery delays, payment gateway issues)
  • Food allergies or dietary reactions

Our total liability shall not exceed the amount paid for the specific order in question.

12. Indemnification

You agree to indemnify and hold harmless 500Kcal.fit, its officers, employees, and partners from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your misuse of the Service
  • Your violation of third-party rights
  • Your negligent or unlawful conduct

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra.

13.2 Arbitration

Disputes may be resolved through binding arbitration in accordance with Indian arbitration laws, at our discretion.

13.3 Customer Support

Before initiating legal action, please contact our customer support to resolve issues amicably.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of the Service after changes constitutes acceptance.
